“POLAR GLOBAL STEP CHALLENGE” COMPETITION
FULL TERMS AND CONDITIONS

Zurich LiveWell Services and Solutions Limited, a subsidiary of Zurich Insurance Group LTD (the “Promoter”) with offices in Gerbergasse 5, 8001 Zurich, Switzerland, CHE-155.782.803 is organizing, in co-ordination with Polar Electro Oy, Professorintie 5, 90440 Kempele, Finland (“Polar”), this Competition, called “POLAR GLOBAL STEP CHALLENGE” (the “Competition”).

Participation in this Competition is free of charge and no purchase is necessary. However, internet access and an Android/iOS smartphone are required to enter. Having a wearable device is not mandatory and won’t affect a participant’s chance of winning a prize. Participants’ internet operator standard data or communication charges shall apply for access to the internet which will be absorbed entirely by the participant.

Any person entering into or participating in this Competition is deemed to have accepted and to be bound by these terms and conditions.

1. ENTRY PERIOD

The Competition is open from 00.01 (UTC+0) on 14/02/2023 until 23.59 (UTC+0) on 5/03/2023 (the “Entry Period”).

2. ENTRANT ELIGIBILITY

This Competition is open to consumers (natural persons only) living in Australia and New Zealand who are 18 years old or over at the start of the Competition (“Eligible Participants”).

Employees of Polar Electro Oy and its respective agents, affiliates, subsidiaries and parent company, sales representatives, marketing affiliates and partners, distributors, advertising and promotional agencies, and immediate family or household members of each, as well as anyone professionally connected to this Competition shall not be entitled to enter and are not eligible for prizes.

The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Participants, including the Eligible Participant’s identity, age and place of residence, and to disqualify any Eligible Participant who breaches these terms and conditions or tampers with the registration process or the Competition.

3. HOW TO ENTER

To enter, Eligible Participants must during the Entry Period:

Download the LiveWell App, connect and sync their wearable device (if they have one) or their smartphone;
Set up their LiveWell App profile and register with first name, last name and email address;
Enroll in the “POLAR GLOBAL STEP CHALLENGE” competition (available in the Boost Tab in the LiveWell App);
Join the Team of their country of residence;
Read and accept these T&Cs; and
Use the LiveWell App to track the number of their steps according with the instructions provided (together, the “Entry Requirements”).

Once an Eligible Participant has completed the steps to satisfy the Entry Requirements, they will receive one (1) entry into the Competition. Only one (1) entry is permitted per person and e-mail address during the entire Entry Period.

4. WINNERS’ SELECTION

This Competition is a game of skill, and chance plays no part in determining the winners.

At the end of the Entry Period, the three (3) Eligible Participants in each Team with the highest total number of steps recorded within the Entry Period and who have satisfied the Entry Requirements will be the Winners (the “Winners”). The assessment of Winners will be carried out by the Promoter.

In case of a tie with more than one Eligible Participant reaching the same highest step count within each Team, the Eligible Participant who registered first wins the tiebreak and will be deemed a Winner.

Prizes will be awarded as follows:

1st ranked Eligible Participant (in each Team) wins: 1x Polar Ignite 3 Fitness Watch; and
2nd and 3rd ranked Eligible Participants (in each Team) each win: 1x Polar H10 Heart Rate Monitor.

5. PRIZES DETAILS

The following prizes are available to be awarded for each Team:

1x Polar Ignite 3 Fitness Watch (approximate retail value: AUD 499)
2x Polar H10 Heart Rate Monitor (approximate retail value: AUD 139)

The prizes are not transferable to third parties and it will not be possible to request an alternative prize, nor a consideration in cash. However, in the event that the promised prize is unavailable, due to unforeseeable circumstances or circumstances beyond the control of the Promoter, the Promoter reserves the right to modify, in whole or in part, the composition of the prize, or to replace it with a prize of equal or greater value.

6. WINNERS’ NOTIFICATION and PRIZE REDEMPTION

Winners will be contacted by email within 14 days of the end of the Entry Period. Winners will be required to contact Polar via a specified e-mail address within 14 calendar days to redeem their prize.

If an Eligible Participant is unable to take the prize or fails to contact Polar with the specified timeframe, the Eligible Participant will be disqualified and the prize will be considered forfeited. In such case, the Promoter reserve the right – at their own discretion – to offer the prize to an alternative winner, selected on the basis of the ranking and excluding individuals who are already Winners. The Promoter accepts no responsibility in the event that a Winner cannot be contacted for any reason, despite reasonable attempts to contact them.

Polar will reply to the Winners’ e-mails within 60 days to provide all the relevant instructions and digital “Winner coupons” to redeem their prize on Polar.com. In summary, the coupon redemption process for the Winners will be:

Visit Polar.com;
Select the Polar Ignite 3 Fitness Watch / Polar H10 Heart Rate Monitor colour of choice;
Add product to the basket (Polar Ignite 3 Fitness Watch or Polar H10 Heart Rate Monitor, depending on the prize awarded to the Winner);
Provide personal and delivery details filling the form accurately;
Add the Winner or Runner Up coupon code and apply the coupon code; and
Choose the delivery option. The Winners will not be liable for any postage or courier costs.

The coupons are only valid until the coupon expiry date specified on the coupon or by the provider and are subject to any terms and conditions imposed by the provider.

All prizes will be delivered by post or courier to Australia or New Zealand only.

The Promoter does not bear liability for any loss caused by incorrect or inaccurate contact details.

The Promoter is entitled to choose the delivery method of all prizes at its sole discretion. The Promoter and Polar are not responsible for any taxes, customs charges or other costs (excluding postage or courier costs) required for or related to receiving a prize. The Promoter will further not compensate any prize that cannot be redeemed or received by a Winner due to customs or other local regulations or that is damaged, delayed or lost by postal, courier or other mail service.

Each Winner is required to independently declare and pay any applicable taxes and charges that a prize gives rise to in the Winner’s jurisdiction.

7. DATA PROCESSING

Personal information provided by and related to the Eligible Participants will be held and used by the Promoter, and its group companies, suppliers and contractors in the extent necessary for carrying out and administering this Competition, in accordance with the Promoter’s Privacy Notice. The Privacy Notice can be read here in the LiveWell App in the menu under “Privacy & Security”.

By participating in the Competition, the Eligible Participants are deemed to accept and to be bound by these terms and conditions and to have given consent to the transfer and processing of their personal data by the Promoter for the purposes of this Competition in accordance with the Promoter’s Privacy Notice.

8. AMENDMENTS TO THE COMPETITION

To the extent permitted by law, the Promoter reserves the right to make changes to the terms of this Competition. Any changes that may be made to these terms during the course of the Competition will be communicated to Eligible Participants via the LiveWell App and/or the email address provided as part of the registration process.

9. GENERAL CLAUSES

Information on how to enter forms part of these terms and conditions. By participating, you agree to be bound by these terms and conditions.

To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, injury (including indirect or consequential loss) suffered by any Eligible Participant entering the Competition or as a result of accepting any prize. However, nothing shall exclude the Promoter’s liability for death or personal injury as a result of its negligence.

The Promoter is not responsible for any technical problems or human error that may result in a registration, submission or entry not being received or being lost or damaged or for any destruction or alteration thereof, or unauthorized access to the Livewell App.

The Promoter’s decisions regarding any aspect of this Competition are final and no correspondence will be entered into. The Promoter may refuse to award a prize to any person, in case of breach of any of the conditions included in these terms.

Eligible Participants must comply with any verification checks which the Promoter may conduct to verify step count during the Entry Period. The Promoter may require Eligible Participants to provide information to the Promoter or its agent as part of the entry verification or prize claim process. Failure to provide information to the Promoter’s satisfaction will result in the relevant entry being declared invalid.

The Promoter reserves the right to withdraw, vary, cancel or suspend an element of a prize if, due to circumstances outside of its control, that element is no longer available. In the event of unforeseen circumstances, the Promoter reserves the right to substitute a prize or an element of the prize for an alternative of equal or greater value.

To the extent permitted by law, the Promoter is not responsible for any third-party acts.

Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these terms and conditions restricts, excludes, or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel this Competition, as appropriate.

The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these conditions of entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

This Competition and these terms and conditions are governed by the laws of New South Wales, Australia and the exclusive jurisdiction of the courts of New South Wales, Australia.
